Overview of Services
Beauty Match LLC ("we", "us", or "our"), also known as Ask A, operates a digital platform facilitating connections between professionals (“Professionals”) and clients (“Clients”), collectively referred to as “Users.” Beauty Match LLC facilitates these connections but does not provide or contract for any services. Agreements for services are made solely between Professionals and Clients. We do not guarantee the quality, suitability, legality or outcomes of any services. While we may conduct background checks at our sole discretion, we make no guarantees or representations that such checks are performed. Users are responsible for their own decisions and safety, particularly in private service locations.
Account Registration and Security
Users must create an account with accurate, current, and truthful information. Account credentials must be kept confidential. Accounts are personal and non-transferable. We reserve the right to suspend or terminate accounts for any violations of these Terms or suspected fraudulent behaviour. Users may link third-party accounts, but we assume no liability for content or privacy practices of such third-party platforms. Account termination may result in the loss of data, and we are not liable for such loss. We encourage Users to back up relevant data.
Payment Processing
We facilitate payments via a third-party Payment Service Provider ("PSP"). By using our platform, Users authorize us to initiate payments, including service fees, cancellation charges, and refunds, as outlined in the Professional's policies. We are not a bank and assume no liability for errors, chargebacks, or delays arising from PSP operations. Users are responsible for compliance with the PSP's terms and conditions. We reserve the right to withhold, refund, or deny transactions suspected of fraud, abuse, or illegality. We will provide notice when feasible but are not obligated to do so.
Use of Services and Content Guidelines
We may modify or discontinue the platform without prior notice. Users must comply with applicable laws of the State of Delaware and must not engage in prohibited conduct including but not limited to spamming, harassment, unauthorized data collection, distributing malware, or infringing third-party rights. Publicly posted content is accessible by others, and Users grant us a worldwide, royalty-free license to use such content to operate and promote the platform. We may remove any content that violates these Terms. Users are strictly prohibited from uploading Protected Health Information (PHI); our platform is not HIPAA-compliant.
Communications and Notifications
Professionals may send messages through the Ask A App, SMS and email communications to Clients, subject to consent. We may also send Users transactional and promotional messages via email, SMS, or automated systems. Users may opt out of promotional communications at any time. Message and data rates may apply. We are not liable for delays or delivery issues caused by mobile carriers. Professionals give permission for Ask A to use in App feedback for marketing purposes
Disclaimers and Liability
The platform and all services are provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant uninterrupted access or the outcome of services. Users assume all risks associated with using the platform and agree to release Beauty Match LLC from any liability for damages, personal injuries, or disputes arising from interactions or transactions conducted via the platform. Nothing in these Terms limits our liability for gross negligence, willful misconduct, or where such limitations are prohibited by law.
Indemnification
Users agree to indemnify and hold harmless Beauty Match LLC, its officers, employees, affiliates, and agents from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of: (1) use or misuse of the platform; (2) violation of these Terms; or (3) infringement of any third-party rights. This indemnification obligation survives account termination.
Dispute Resolution
All disputes must first be resolved through informal negotiation within 30 days of notification. If unresolved, disputes will be settled via binding arbitration administered by the American Arbitration Association, conducted in San Francisco, California, under the Federal Arbitration Act and applicable California law. Users waive their rights to trial by jury and to participate in class actions, to the extent permitted by law. Arbitration may be conducted remotely. Users may opt out of this provision by notifying us in writing within 30 days of account creation.
Privacy and Security
Our collection and use of personal information is governed by our Privacy Policy. We implement technical and organizational safeguards to protect your data but cannot guarantee absolute security. Users should refrain from submitting sensitive personal information and do so at their own risk.
Additional Programs and Gift Cards We may introduce programs, promotions, and loyalty initiatives at our discretion, which may be amended or discontinued at any time. Gift Cards are non-replaceable if lost or stolen, non-transferable, and not redeemable for cash unless required by law. Use of Gift Cards is governed by additional terms, which may limit their combination with other promotions or expiration.
